New obligations in the transport sector as a result of the Macron Law

Since 1 July 2016, France has been applying the Macron Lax. This law subjects all foreign truck drivers who drive to or through France to the same social rules as French drivers.

This means that the truck drivers should receive at least the French minimum wage of 9.67 euros an hour. Moreover, the non-French hauliers who employ the drivers are required to appoint a representative in France. This representative acts as the contact point for the controlling French authorities. In addition, a large number of formalities must be met, such as drafting a certificate of posting for every driver and keeping extensive paperwok on board the vehicle.
Fines for non-compliance with the obligations of the Loi Macron are not insignificant. Employers who are not in order with their certificates of posting or who have not appointed a French representative risk fines ranging from EUR 450 to EUR 4,000 per employee.
